Introduction
A ‘contract’ is defined under Section 2(h) as an agreement enforceable by law. A painting contract is a contract concerning the tasks related to the painting of residential or commercial property or even public buildings. It is basically a legal contract between the painter and the customer providing for the painting tasks to be accomplished by the contractor, the amount of money to be paid for the task, the deadline for completion of the work, etc. Once it is signed by both parties, it becomes binding on them and becomes legally enforceable if in consonance with the law of the land.
Essentials
In order to be considered a legally enforceable painting contract, the following essentials are supposed to be fulfilled:
There must be an offer made by one party.
The offer must have been accepted by the other party or parties.
It must provide valid consideration in exchange for the task of painting under the contract.
It must not provide for anything which is considered illegal under the law.
Both or all the parties to such a contract must agree to the terms of the contract and are supposed to sign it.
Both the parties entering into such a contract must be competent, and they must be of sound mind.
The assent of the parties to such a contract must be out of their own free will.
It may be oral or written, but the written form is preferred as it involves lesser chances of disputes with respect to the terms and conditions.
Particulars to be provided under Painting Contracts
Details of the parties: It must specify the name and details of the painting contractors and that of the customer. It must also specify whether the painting contractor is an independent contractor or not.
Description of Work: It must provide for the expectations of the customer regarding the work. It must specify what is supposed to be painted, the number of coats of paint, and if there is a need for any cover-up at the end, etc. It must also specify the area which needs to be painted by the contractor. It must also specify if it is for exterior or interior painting or both of the premises. The work is supposed to be done in accordance with industrial standards.
Material: It must also specify what sort or quality of the material should be used by the contractor. It should also specify if the material to be used will be provided by the customer or is to be bought by the contractors themselves.
Deadline: It must also specify the deadlines by which the task is supposed to be accomplished. It may also provide an additional benefit that would be provided to the contractor on completion of the task before the expiry date.
Payment of the Consideration: It must specify the mode of the payment, i.e. how the payment will be made, by what date, at what place, etc. It must specify if the payment is to be made in installments and the deadline for each such installment.
Warranty: It must also specify the warranty of the painting task. In most cases, it ranges from two to five years with common exclusions like inclement weather or fire, etc.
Exit Clause: It must also specify the remedy in case of breach of the contract by one of the parties to the contract.
Damage Clause: It must also specify if the contractor is supposed to accomplish the task diligently or if he will be held responsible in case of any damage caused to their property.
Conclusion
A painting contract is a legally enforceable contract that takes place between a painter and the customer who wants to get the premises painted. It may be related to the interior or exterior painting of a residential property or commercial property. Even the government can enter into such contracts to get public buildings painted from time to time. Such a contract must provide for the terms and conditions for work, description of work, details of the parties, payment amount and time, the deadline by which the task is supposed to be accomplished, warranty, exit cause, damage clause, etc.
